These Terms of Service ("Terms") govern your use of the accident-report.org website and any related subdomain (including texas.accident-report.org) (collectively, the "Site"), operated by Legal Leadz LLC ("Legal Leadz," "we," "us," or "our"), a Florida limited liability company. By accessing or using the Site, or by submitting any information through any form on the Site, you ("you" or "your") agree to be bound by these Terms. If you do not agree, do not use the Site.
The Site provides information about motor vehicle accidents, accident-report retrieval, and related topics, and offers a means by which individuals may submit their information for evaluation by a participating law firm regarding potential legal representation. The Site is operated by Legal Leadz LLC. We are not a law firm. We do not provide legal advice. Submission of information through the Site does not create an attorney-client relationship between you and Legal Leadz, and does not create an attorney-client relationship between you and any law firm unless and until you and that law firm separately enter into a written representation agreement.
You must be at least eighteen (18) years of age to use the Site or submit information through any form. By using the Site, you represent and warrant that you are at least eighteen (18) and that you have the legal capacity to enter into these Terms.
You agree that any information you submit through the Site is true, accurate, current, and complete to the best of your knowledge. You are responsible for the accuracy of the information you submit. Submitting false or misleading information may result in delay or denial of legal representation by the participating law firm and may constitute a violation of applicable law.
Your information will be used and shared as described in our Privacy Policy, which is incorporated by reference into these Terms. By submitting information through the Site, you authorize Legal Leadz to share that information with one (1) participating law firm for evaluation of potential representation.
By submitting your information through a form on the Site that includes consent language, you provide express written consent under the Telephone Consumer Protection Act (47 U.S.C. § 227) to receive follow-up communications by telephone, SMS, or email from us or from the participating law firm to whom your information is delivered. Consent is not a condition of any purchase or service. You may opt out of SMS communications at any time by replying STOP to any message and may opt out of marketing telephone calls by contacting [email protected].
Legal Leadz is a marketing and information-services company. Nothing on the Site, in any communication from Legal Leadz, or in your submission of information through the Site constitutes the practice of law, the provision of legal advice, or the formation of an attorney-client relationship between you and Legal Leadz. Any attorney-client relationship that may be formed will be exclusively between you and a law firm that you and that firm separately agree to engage.
Legal Leadz does not guarantee that any participating law firm will agree to represent you, that any case will result in a settlement or judgment, or that any particular financial result will be obtained. Any participating law firm independently evaluates each potential client and decides whether to offer representation. The selection of a law firm is a personal decision and you should consider the firm's qualifications, fees, and reputation before entering into a representation agreement.
You agree not to:
Use the Site for any unlawful, fraudulent, or harmful purpose
Interfere with or disrupt the Site, its servers, or networks
Attempt to gain unauthorized access to any portion of the Site or any related systems
Use any automated means (bots, scrapers, harvesters) to access or collect information from the Site
Submit false, misleading, or deceptive information
Reproduce, modify, distribute, or create derivative works of any portion of the Site without our prior written consent
Impersonate any person or misrepresent your affiliation with any person or entity
All content on the Site, including text, graphics, logos, software, and design, is the property of Legal Leadz LLC or its licensors and is protected by U.S. and international intellectual property laws. Nothing in these Terms grants you any right, title, or interest in our intellectual property. You may not reproduce, modify, distribute, or create derivative works of our content without prior written consent.
The Site may contain links to third-party websites. We are not responsible for the content, privacy practices, or terms of any third-party site. Your use of any third-party site is at your own risk.
THE SITE AND ALL CONTENT, INFORMATION, AND SERVICES PROVIDED THROUGH THE SITE ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, OR THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. LEGAL LEADZ DOES NOT WARRANT THAT INFORMATION ON THE SITE IS ACCURATE, COMPLETE, OR CURRENT, AND ANY RELIANCE YOU PLACE ON SUCH INFORMATION IS AT YOUR OWN RISK.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL LEGAL LEADZ LLC, ITS MEMBERS, OFFICERS, EMPLOYEES, AGENTS, OR CONTRACTORS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOST PROFITS, LOSS OF DATA, OR DAMAGE TO REPUTATION, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, EVEN IF LEGAL LEADZ HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL LEGAL LEADZ'S AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE EXCEED ONE HUNDRED DOLLARS (USD $100.00) OR THE AMOUNT YOU PAID TO LEGAL LEADZ IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, WHICHEVER IS GREATER.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE EXCLUSIONS OR LIMITATIONS MAY NOT APPLY.
You agree to indemnify, defend, and hold harmless Legal Leadz LLC and its members, officers, employees, agents, and contractors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of the Site, (b) your breach of these Terms, (c) your violation of any applicable law or third-party right, or (d) any false or misleading information you submit through the Site.
These Terms and any dispute arising under them are governed by the laws of the State of Florida, without regard to its conflict of law provisions. The parties agree that the United Nations Convention on Contracts for the International Sale of Goods does not apply.
Before initiating any formal proceeding, the parties agree to attempt in good faith to resolve any dispute through informal negotiation. If a dispute cannot be resolved informally within thirty (30) days of written notice, either party may pursue available remedies.
Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Pinellas County, Florida. The parties consent to the personal jurisdiction of such courts and waive any objection to venue in such courts.
TO THE EXTENT PERMITTED BY APPLICABLE LAW, EACH PARTY IRREVOCABLY WAIVES ANY RIGHT TO A TRIAL BY JURY IN ANY LEGAL PROCEEDING ARISING OUT OF OR RELATED TO THESE TERMS.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Legal Leadz with respect to the Site and supersede all prior and contemporaneous agreements, representations, and understandings.
Legal Leadz may modify these Terms at any time by posting the updated Terms on the Site with a revised "Last Updated" date. Your continued use of the Site after the effective date of any amendment constitutes acceptance of the updated Terms.
If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in full force and effect.
No waiver of any provision of these Terms is effective unless in writing. Failure to enforce any provision is not a waiver of that or any other provision.
Neither party will be liable for any delay or failure to perform due to causes beyond its reasonable control, including acts of God, war, terrorism, pandemic, governmental actions, natural disasters, or internet or infrastructure failures.
These Terms are solely for the benefit of you and Legal Leadz. Nothing in these Terms creates any rights in any third party.
